Commissions Policy
General Information
All commissions are accepted at the discretion of Lauren McAvoy Art and are subject to availability.By commissioning artwork from Lauren McAvoy Art, the Client agrees to the terms set out in this policy.Commission fees cover the creation of the Artwork only and do not include the transfer of copyright, intellectual property rights, reproduction rights, commercial rights, or artificial intelligence usage rights unless expressly agreed in writing.Initial Enquiry
The Client should provide as much information as possible regarding the requested commission, including subject matter, preferred size or format, intended use, and any relevant reference material.
Following discussion of the project, a quotation and estimated completion timeframe will be provided.
Booking Deposit
A non-refundable deposit equal to 50% of the total commission price (excluding shipping costs) is required before any work will commence. The deposit secures the commission slot and covers time spent on consultation, correspondence, concept development, planning, reference gathering, preliminary sketches, reserving studio availability, and other preparatory work associated with the commission.The remaining balance is due upon completion of the Artwork and must be paid in full before high-resolution digital files are delivered or physical artwork is dispatched.Sketches and Revisions
Preliminary sketches, concepts, drafts, mock-ups, studies, and work-in-progress materials may be provided during the commission process for review and approval.The commission fee includes up to two rounds of reasonable revisions during the sketch stage unless otherwise agreed.Approval of a sketch, concept, composition, layout, pose, or design constitutes acceptance of that stage of the commission.Requests for substantial changes after sketch approval may incur additional charges and may affect completion times.Deadline & Delivery Policy
Any completion, shipment, or delivery date requested by the Client is considered a request only and does not constitute a guaranteed deadline. Acceptance of a commission does not imply or create any guarantee that the commissioned artwork will be completed, shipped, or delivered by a specific date.Commission slots should be reserved as far in advance as possible. Clients are strongly encouraged to book several months ahead of any desired completion or delivery date to allow sufficient time for scheduling, creation, revisions (where applicable), preparation for shipment, and transit. Production timelines may vary depending on the scope and complexity of the commission, the Artist's workload, and other operational considerations.The Artist will make reasonable efforts to accommodate requested timeframes; however, all estimated completion, shipment, and delivery dates are provided in good faith and are subject to change without notice.The Artist shall not be liable for delays caused by circumstances beyond their reasonable control, including, but not limited to, illness, injury, family emergencies, material shortages, supplier delays, equipment failure, postal or courier disruptions, customs processing, adverse weather conditions, natural disasters, labour disputes, or other unforeseen events.By commissioning artwork, the Client acknowledges and agrees that completion, shipment, and delivery dates cannot be guaranteed and that delays may occur despite the Artist's reasonable efforts to meet requested timeframes. The Artist shall not be liable for delays or losses resulting from circumstances beyond their reasonable control.Client Communication
The Client agrees to respond to requests for feedback, approvals, or required information within a reasonable timeframe.Where the Client fails to respond for a period exceeding 30 days, the Artist reserves the right to place the commission on hold, reschedule the commission, or treat the commission as cancelled. In such circumstances, the booking deposit shall remain non-refundable.Shipping and Risk of Loss
Shipping costs are not included in commission prices unless expressly stated otherwise and will vary depending on the destination, package size, and shipping method selected.The Artist will take reasonable care in packaging and dispatching physical artwork. Once artwork has been transferred to the postal service, courier, or other delivery provider, delivery times are outside the Artist's control.The Client is responsible for providing accurate delivery information. The Artist shall not be responsible for delays, losses, additional charges, or failed deliveries resulting from incorrect or incomplete shipping information supplied by the Client.Any customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country are the sole responsibility of the Client.Cancellation
The non-refundable 50% booking deposit secures the commission slot and covers administrative, planning, and preparatory work undertaken by the Artist. If the Client cancels the commission before work has commenced, the deposit shall remain non-refundable, and no further payment shall be due.
If the Client cancels the commission after work has commenced, the Client shall remain responsible for payment for all work completed up to the date of cancellation. Where the value of work completed exceeds the amount already paid through the deposit, the Artist reserves the right to invoice the Client for the outstanding balance corresponding to the percentage of the commission completed.For example, if a commission is 60% complete at the time of cancellation and the Client has paid a 50% deposit, the Client will remain liable for the additional 10% of the total commission price.
Upon cancellation, all rights to any unfinished or completed artwork shall remain with the Artist unless otherwise agreed in writing.Copyright and Ownership
Unless otherwise agreed in writing, all copyright, intellectual property rights, and related rights in the Artwork remain the exclusive property of Lauren McAvoy Art.Payment for a Commission does not transfer copyright ownership to the Client.Ownership of any physical artwork transfers upon receipt of full payment. Copyright remains with the Artist at all times unless expressly assigned in writing.Permitted Use
The Client is granted a non-exclusive, non-transferable licence to display and enjoy the Artwork for personal, private, and non-commercial purposes only.The Client may not, without the Artist's prior written consent:Reproduce, copy, scan, distribute, publish, or otherwise reproduce the Artwork.Create prints, merchandise, products, publications, or derivative works based upon the Artwork.Use the Artwork for advertising, promotion, marketing, branding, publishing, fundraising, business activities, or any revenue-generating purpose.Sell, licence, sublicense, transfer, or commercially exploit the Artwork.Claim ownership of any intellectual property rights in the Artwork.
Any commercial use of the Artwork requires a separate written licence and may be subject to additional licensing fees.Intellectual Property and Preliminary Materials
All sketches, concepts, drafts, studies, mock-ups, work-in-progress images, and other preliminary materials created during the commission process remain the exclusive intellectual property of Lauren McAvoy Art.Such materials are provided solely for the Client's review and approval in connection with the Commission.The Client may not reproduce, distribute, publish, sell, licence, modify, provide to another artist, or otherwise use any preliminary materials for any purpose other than reviewing the progress of the Commission.Copyright and all intellectual property rights in such materials remain vested in Lauren McAvoy Art whether or not the Commission proceeds to completion.Artificial Intelligence and Machine Learning Restrictions
The Client acknowledges that all sketches, concepts, drafts, work-in-progress materials, and completed Artwork are protected by copyright and other intellectual property rights.Unless expressly authorised in writing by the Artist, the Client shall not upload, submit, share, reproduce, distribute, process, analyse, modify, adapt, reverse engineer, or otherwise use any artwork or preliminary materials in connection with any artificial intelligence, machine learning, generative AI, image generation, image manipulation, style transfer, data mining, training, fine-tuning, or similar automated system.This restriction applies to both preliminary materials and completed Artwork, whether provided digitally or in physical form.The Client shall not use the Artwork, or permit any third party to use the Artwork, for the training, development, testing, operation, improvement, or evaluation of any artificial intelligence or machine learning model without the Artist's prior written consent.Any rights granted to the Client under this policy are subject to this restriction and do not include any AI-related use whatsoever.Portfolio and Promotion
Unless otherwise agreed in writing, Lauren McAvoy Art reserves the right to display commissioned Artwork, preliminary sketches, and work-in-progress images within portfolios, exhibitions, websites, social media channels, promotional materials, and other marketing activities.Where a project is confidential, unpublished, or commercially sensitive, this should be discussed prior to commencement of the Commission.Artist Cancellation
If the Artist is unable to complete the commission for any reason, the Artist reserves the right to cancel the commission and refund any amounts paid by the Client for work not yet completed.Refusal of Commissions
Lauren McAvoy Art reserves the right to decline any commission request without obligation to provide a reason.Commissions may be declined where the subject matter falls outside the Artist's style, expertise, availability, personal values, or professional standards.Completion and Collection
Upon notification that the Artwork has been completed, the Client shall pay any outstanding balance within 14 days unless otherwise agreed in writing.The Artist reserves the right to withhold delivery, dispatch, or release of the Artwork until all outstanding amounts have been paid in full.Governing Law
This policy and any commission agreement between the Artist and the Client shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with a commission shall be subject to the exclusive jurisdiction of the courts of England and Wales
